Last Updated: June 2, 2025
1. Introduction
Welcome to Pixel and Code. These Terms of Service ("Terms") govern your use of our website, products, and services ("Services"). By accessing or using our Services, you agree to be bound by these Terms. If you disagree with any part of the Terms, you may not access the Services.
2. Use of Services
Our Services are intended for users who are at least 18 years old. By using our Services, you represent and warrant that you are at least 18 years old and that your use of the Services does not violate any applicable laws or regulations.
You are responsible for maintaining the confidentiality of your account and password and for restricting access to your computer. You agree to accept responsibility for all activities that occur under your account or password.
3. Intellectual Property
The Services and their original content, features, and functionality are and will remain the exclusive property of Pixel and Code and its licensors. The Services are protected by copyright, trademark, and other laws of both the United States and foreign countries.
Our trademarks and trade dress may not be used in connection with any product or service without the prior written consent of Pixel and Code.
4. User Content
Our Services may allow you to post, link, store, share and otherwise make available certain information, text, graphics, videos, or other material ("User Content"). You are responsible for the User Content that you post on or through the Services, including its legality, reliability, and appropriateness.
By posting User Content on or through the Services, you represent and warrant that:
- The User Content is yours (you own it) or you have the right to use it and grant us the rights and license as provided in these Terms.
- The posting of your User Content on or through the Services does not violate the privacy rights, publicity rights, copyrights, contract rights or any other rights of any person.
We reserve the right to terminate the account of any user who infringes copyrights or other intellectual property rights.
5. Payment Terms
For any paid Services, you agree to pay all fees or charges to your account based on the fees, charges, and billing terms in effect at the time a fee or charge is due and payable. If, in our judgment, your purchase constitutes a high-risk transaction, we may require you to provide us with a copy of your valid photo ID, and possibly a copy of a recent bank statement for the credit or debit card used for the purchase.
You are responsible for paying all taxes associated with your purchases. If you pay by credit or debit card, you represent and warrant that the information you provide is accurate, that you are authorized to use the card, and that you will notify us of any changes to the card information.
6. Service Availability and Modifications
We reserve the right to withdraw or amend our Services, and any service or material we provide via the Services, in our sole discretion without notice. We will not be liable if for any reason all or any part of the Services are unavailable at any time or for any period.
We may update the content on our Services from time to time, but its content is not necessarily complete or up-to-date. Any of the material on our Services may be out of date at any given time, and we are under no obligation to update such material.
7. Links to Third-Party Websites
Our Services may contain links to third-party websites or services that are not owned or controlled by Pixel and Code. We have no control over, and assume no responsibility for, the content, privacy policies, or practices of any third-party websites or services.
You further acknowledge and agree that Pixel and Code shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with the use of or reliance on any such content, goods, or services available on or through any such websites or services.
8. Limitation of Liability
In no event shall Pixel and Code, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from:
- Your access to or use of or inability to access or use the Services;
- Any conduct or content of any third party on the Services;
- Any content obtained from the Services; and
- Unauthorized access, use, or alteration of your transmissions or content.
9. Indemnification
You agree to defend, indemnify, and hold harmless Pixel and Code, its parent, subsidiaries, affiliates, and their respective directors, officers, employees, contractors, agents, suppliers, licensors, successors, and assigns from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to your violation of these Terms or your use of the Services.
10. Governing Law
These Terms shall be governed and construed in accordance with the laws of the State of California, United States, without regard to its conflict of law provisions. Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.
If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect. These Terms constitute the entire agreement between us regarding our Services, and supersede and replace any prior agreements we might have had between us regarding the Services.
11. Changes to Terms
We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.
By continuing to access or use our Services after any revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, you are no longer authorized to use the Services.
